Another Judge needs removal

Good day, it looks like we have another judge and District Attorney in need of lessons in things like the Constitution of the United States. They are trying to railroad someone into prison for 13 years for writing nasty things about a bank with CHALK!

No, I am not kidding. Here are the details of this travesty of justice from RT.com:

Jeff Olson, the 40-year-old man who is being prosecuted for scrawling anti-megabank messages on sidewalks in water-soluble chalk last year now faces a 13-year jail sentence. A judge has barred his attorney from mentioning freedom of speech during trial.

According to the San Diego Reader, which reported on Tuesday that a judge had opted to prevent Olson’s attorney from “mentioning the First Amendment, free speech, free expression, public forum, expressive conduct, or political speech during the trial,” Olson must now stand trial for on 13 counts of vandalism.

Excuse me? And who does this corrupt black robed tyrant think he is? And vandalism? Mr. Olson used materials specifically designed NOT to do any damage. Worst case, it would be 15 minutes with a hose to wash down the sidewalks.

In addition to possibly spending years in jail, Olson will also be held liable for fines of up to $13,000 over the anti-big-bank slogans that were left using washable children’s chalk on a sidewalk outside of three San Diego, California branches of Bank of America, the massive conglomerate that received $45 billion in interest-free loans from the US government in 2008-2009 in a bid to keep it solvent after bad bets went south.

And there’s your answer. This bank is run by Obama cronies who are part of the Progressive Liberal Elite, (Read Fascist), who hate things like free speech, the right to keep and bear arms ((Bank of America Freezes Gun Manufacturer’s Account, Company Owner Claims)), etc. So what did Mr. Olson actually write? Was it threats of violence? Not exactly. From Reuters:

Olson has admitted to the graffiti protests, but said nothing he wrote was profane or vulgar and suggested his prosecution was politically motivated.

“I wrote, ‘No thanks big banks.’ I wrote, ‘Shame on Bank of America,'” he told San Diego CBS television affiliate KFMB-TV. He told another local station, ABC affiliate KGTV: “If I had drawn a little girl’s hopscotch squares on the street, we wouldn’t be here today.”

Nope, I don’t see anything obscene or threatening there. This was just someone posting their opinion and doing so in a way that would not cause damage or require extensive cleanup costs. (In fact, all you need to do is wait for the next rain storm) Considering how groups like Occupy Wall Street like to destroy anything they don’t like, this is the correct way to protest something. So, exactly what was the reasoning behind Judge Howard Shore’s decision to negate the First Amendment? You won’t believe it.

“The State’s Vandalism Statute does not mention First Amendment rights,” ruled Judge Shore on Tuesday.

It doesn’t mention it because there was never a need to, until now apparently. No one thought a judge would be so stupid as to refuse to allow the First Amendment into a case as a defense. The attorney for Mr. Olson, Tom Tosdal was floored by this decision.

Tosdal, who exited the courtroom shortly after his client, seemed equally bewildered.

“I’ve never heard that before, that a court can prohibit an argument of First Amendment rights,” said Tosdal.

And it gets better. This tyrant has also instituted a gag order on Jeff Olson and his attorney. They are forbidden from talking about this case outside of the court room.

On Thursday, Superior Court Judge Howard Shore issued a gag order in the case, forbidding all parties from discussing the trial further. He previously ruled that Olson would not be permitted to invoke freedom of expression as a defense in the case.

This case, much like the Zimmerman case in Florida, smacks of politics. From what I’m reading, there is a bit of a fight going on between the mayor’s office and the City Attorney, Jan Goldsmith. Apparently Goldsmith and the mayor, Bob Filnor get along like fire and Nitro.

Mayor Bob Filner has denounced the prosecution of Jeff Olson, 40, a man with no previous criminal record, as a waste of taxpayer money and an abuse of power that infringes on First Amendment free speech protections in the U.S. Constitution.

“This young man is being persecuted for thirteen counts of vandalism stemming from an expression of political protest that involved washable children’s chalk on a city sidewalk,” the mayor said last week in a memo to the City Council.

The Olson case has become the latest flashpoint in a deepening rift between Filner and Goldsmith, who was elected city attorney under the former mayor by promising to improve the office’s ability to work with the city’s top elected official.

The mayor and city attorney have clashed over medical marijuana dispensary crackdowns, tourism district funds, bond issues and the mayor’s recent successful effort to cut $500,000 from the city attorney’s budget.

So it seems the City Attorney is using this case to get even with the mayor? And it seems we have a pliable judge who is either dumber then a box of hammers or owes Goldsmith something. That’s the only reason I can see that would allow this idiot to issue this type of ruling.

Now, it seems that Jeff Olson is not a sweetheart of the right. He is an Occupy Wall street moonbat. However, he seems to have not gone in for the trashing, raping, robbing and murdering that was part and parcel for most of this movements history. This doesn’t excuse the ruling by this clod in black robes. As far as I can see, if this goes to a conviction, there are many avenues for appeal and deservedly so. Getting a sentence of 13 years for a little chalk is clearly a punishment not fitting the crime, if any sort of crime was actually committed. At best, considering that no damage was done, a small fine. Spending more time in prison then a rapist is a clear miscarriage of justice, even for an Occupy Wall street moonbat. Hopefully, the voters in that district will bounce this nitwit off the bench along with the City attorney.

Mr. Olson has been acquitted of all charges by the jury hearing this case.
