Good day all. The current session of the Supreme Court is coming to a close and this is the time of year they start releasing all their big, usually wrong, decisions.
One of those decision is the King v Burwell case. This is case regarding the Obamacare subsidies. In a nutshell, the way the Obamacare law is written, only the states that set up and run their own Obamacare exchanges are entitled to a taxpayer subsidy. The plan was to force states into creating exchanges so they could get their free money. In fact, this was exactly what Jonathon Gruber had in mind when he helped write this abomination.
There was just one or two small problems. More then half the states decided not to set up exchanges, instead forcing people into the federal exchange, and of those states that did set up their own exchanges, most failed miserably and either didn’t work or have been shut down.
According to the Obamacare law as written, people in those states were not entitled to a subsidy. Realizing what a disaster this would be, His Imperious Majesty, Barack Obama decreed, in apparent violation of the law, to grant subsidies to all. After all, he must always look good.
Well, a number of states sued and it made it to the Supreme Court. After people heard the arguments given to the justices, and their questions, it doesn’t look good for the subsidies. That has set off the Obama minions as they begin to realize that the court won’t just rewrite the law to help them out. To refresh your memory, here is the section in question:
The monthly premiums for such month for 1 or more qualified health plans offered in the individual market within a State which cover the taxpayer, the taxpayer’s spouse, or any dependent (as defined in section 152) of the taxpayer and which were enrolled in through an Exchange established by the State under 1311 of the Patient Protection and Affordable Care Act.
The key part there is “an Exchange established by the State.” In the United States, referring to “The State” has a very specific meaning. It doesn’t refer to the central Federal Government and it never has. For the Supreme Court to rewrite this would be to toss the entire foundation of this country out the window. Considering that to do so would probably mean states outright refusing to acknowledge the court, this could set up a full blown constitutional crises that the court would lose.
It’s beginning to sink in to the Obama regime that the odds are they will lose this case, especially after the hammering Chief Justice John Roberts took after his last bad decision on Obamacare. Thanks to that decision, the court is being held in the lowest regard since the Civil War. Now, in preparation to the anticipated crushing defeat, Obama and his thugs are trying to make it look like this is the Republicans fault and that they have to fix the mess Obama, Pelosi and Reid made. Here are some of the details from Fox News:
President Obama’s top health official testified Wednesday that if the Supreme Court issues a ruling that upends the Affordable Care Act, it’s up to Congress and the states to figure out a solution. Health and Human Services Secretary Sylvia Mathews Burwell, testifying before the House Ways and Means Committee, addressed questions over what will happen if the court rules against the administration on the health law. Burwell made clear that the administration is not offering an alternative plan at this point, and instead wants Congress and the states to work it out.
In other words, “If we can’t have it our way, then Eff You! You fix it!”
“If the court says that we do not have the authority to give subsidies, the critical decisions will sit with the Congress and states and governors to determine if those subsidies are available,” she testified, adding that the administration would be “ready to communicate” and work with states to “do everything we can.”
In other words, they want to get the states to hammer on Congress to give them more money to fix the law they have been ignoring in the first place.
In advance of a decision, Republican congressional leaders say they are preparing for the possibility that a huge chunk of the subsidies could be invalidated. While Obama would want Congress to simply tweak the law to allow for subsidies to cover Americans in all exchanges, it’s unclear whether the congressional response would be that simple.
If I recall correctly, Boehner and McConnell have said they will put the subsides back, utterly failing to understand that most Americans don’t want Obamacare fixed, they want it gone. I won’t bother going into some of the fixes I’ve suggested, you can dig them out yourselves.
“Depending on what the Supreme Court decides, we will have a proposal that protects the American people from a very bad law,” Senate Majority Leader Mitch McConnell, R-Ky., told Fox News’ Bret Baier on Tuesday, without going into detail.
Of course he didn’t go into detail, just as he refused to go into detail on what the bills to give Obama fast track authority on trade last week. We saw how well that went for Obama, Boehner and McConnell. I will say that Paul Ryan may have figured it out, but I’m not to sure.
On Wednesday, House Ways and Means Committee Chairman Paul Ryan, R-Wis., also said there is no “quick fix.” “Whatever the Supreme Court decides this month, I think the lesson is clear. Obamacare is busted. It just doesn’t work. And no quick fix can change this fact,” Ryan said in prepared remarks, renewing the call to “repeal and replace” the law.
No dummy, there is a quick fix. End all the mandates, let insurance companies sell across state lines as well as a few other things. Oh wait. None of that will require a massive government bureaucracy. Well, Ryan’s probably on his last term now anyway, thanks to his remarks on the Trade Authority bill that was crushed last week. Maybe he can go work with Eric Cantor. I understand he’s doing quite well at “Has Been Inc.”
Then, we have King Putt himself shooting his big mouth off. President tone deaf took some time on the back nine to comment on his impending defeat.
Obama also said Tuesday that his law was now embedded in the country’s health care system and said the court shouldn’t have accepted the case. He also mocked “unending Chicken Little warnings” from opponents who warned that the law would abridge people’s freedom.
“There’s something, I have to say, just deeply cynical about the ceaseless, endless partisan attempts to roll back progress,” Obama said at the Catholic Hospital Association conference.
Considering that his Regime has been at the forefront of suppressing Christians and Jews, and that the courts have been slapping him down repeatedly, it’s obvious that President SCoaMF is suffering from extreme delusions. Still, Der Fubar is counting on the Imperial Propaganda Corps to help him out once again.
A court victory by the conservatives could put disproportionate political pressure on Republicans to help those who’ve lost subsidies. Of the 34 states likeliest to be most affected by such a ruling, 26 have GOP governors. And 22 of the 24 GOP senators up for re-election next year are from those same states.
And if you think that people will rise up and throw them all out of office and put in communists Democrats, think again. The Democrats have shown people their true colors, They are believers in the total power of the government over the rights of the people. If the court does the right thing and rules this provision unconstitutional, and the RINO’s try to save it, well, the political bloodbath for the Republican party will probably kill the party as it now exists.
Top House and Senate Republicans have been working privately toward legislation restoring aid to those losing it until sometime in 2017. It would also eliminate parts of the health overhaul, such as its requirement that companies insure workers. That would almost certainly draw a veto from Obama.
How about no. Don’t do anything to save this disaster. What part of 60+ percent of the people saying no isn’t not sinking into the heads of the RINO leadership? As to Obama vetoing it? Fine. He will be the one who kills Obamacare. Sort of poetic, don’t you think?
Republican lawmakers say they will unveil their plan once the justices rule, though there are no indications they have united behind a particular plan. They hope a Republican will inhabit the White House in 2017 so they can repeal the current law and enact one less expansive.
That presumes that the RINO’s don’t once again put a moron on the ticket that people can’t stand. (Hint: Jeb Bush, Chris Christy) Well, we will just have to wait until the decision is released. I would not, for one instant, put it past that scumbag Roberts to once again legislate from the bench. I also have no doubt that the constitutionally and ethically challenged members will also fall in line with more power for Obama and moving us closer to an imperial presidency.
