EPA to the Federal Courts: Up Yours Bub!”

Good day all. Last week a federal judge, Ralph Erickson of the District Court for the District of North Dakota, stopped the latest power grab by the Environmental Pollution Agency. The new rules would have basically given the EPA absolute power of everyone’s property.

The response by the EPA when told that their new regulations were blocked was simple and demonstrates that this agency must be closed down. They announced they were going to enforce the new regulations anyway and the hell with the courts. Here are some of the details from Fox News:

The Environmental Protection Agency says it is going forward with a new federal rule to protect small streams, tributaries and wetlands, despite a court ruling that blocked the measure in 13 central and Western states. The EPA says the rule, which took effect Friday in more than three dozen states, will safeguard drinking water for millions of Americans.

Actually, it doesn’t. The goal is to end the property rights of millions of Americans. So, what’s the EPA’s excuse for ignoring a federal judge? According to The Hill:

In a statement shortly after the ruling, the EPA was defiant and said that the injunction only applies in the 13 states that filed for it: Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota, South Dakota and Wyoming. “In all other respects, the rule is effective on August 28,” EPA Press Secretary Melissa Harrison said in the statement. “The agencies are evaluating these orders and considering next steps in the litigation.”

While I am not a lawyer, I think that a federal court decision is in effect across the United States unless another court of the same level comes to a different conclusion. This is the reason that cases end up in front of the Supreme Court. You have to federal courts disagreeing with each other. As far as I know, this isn’t the case here.

What happens next when the EPA stormtroopers arrive on a farm or a ranch that isn’t “protected” by this ruling and start making demands? Under the worst case scenario, you will have shots fired, and them the whole thing blows up. You could end up with a “Bundy Ranch” scenario that ends up with a full blown gun battle between the EPA, the citizens and possibly local and state law enforcement coming in on the citizens side. That sort of scenario came very close to happening in Nevada a year and a half ago.

Thanks to Obama and his minions, a congress that has walked away from it’s oversight responsibilities and government agencies that are acting as a law unto themselves, the United States is the closest it’s been to a full blown civil war since the 1850’s. I don’t know what Donald Trump’s position is on dealing with these lawless agencies. Perhaps someone should ask. The right answer and he will be the next president of the United States.
