Judge Bans crackdown on Sanctuary Cities

Good day all. Recently, the Trump Administration has started to withhold federal funds from cities that refuse to uphold the rule of law, and actively aid criminal aliens in staying in the United States. Yesterday, a judge “Permanently banned” the executive order withholding these funds. The Judge in question? U.S. District Court Judge William Orrick.

Orrick has made a bit of a name for himself of late, aiding and abetting illegal aliens with his flat out illegal court rulings. Most of his rulings are under appeal or have already been overturned by the Supreme Court. However, being an Obama Judge, appointed for life, means he can ignore the USSC and issue rulings that have no basis in the Law or Constitution. Here are the details of this Proglodyte Moonbat’s latest pronouncement from the bench from Fox News:

A federal judge in California on Monday permanently blocked President Trump’s executive order to withhold federal funding from sanctuary cities that do not cooperate with U.S. immigration authorities. U.S. District Court Judge William Orrick ruled that the White House does not have the authority to impose new conditions on spending already approved by Congress.

The Counties have demonstrated that the Executive Order has caused and will cause them constitutional injuries by violating the separation of powers doctrine and depriving them of their Tenth and Fifth Amendment rights,” the judge wrote in his order.

This judge’s decision is problematical at best. According to Jazz Shaw at Hot Air:

The decision itself remains just as dubious as the previous ruling. Orrick is claiming that the President doesn’t have the authority to repurpose funds which Congress has already authorized. That’s vague at best and seems to ignore the fact that we’re talking about money given to the Executive Branch for the purpose of issuing grants.

That means there’s an application process (which we’ve covered here before) and not everyone who applies for one will receive the funding.

Further, it’s the Justice Department who determines the criteria for receiving such grants. Congress simply made the funding available to set up and maintain the program.

So once again, an Obama Judge is usurping authority he doesn’t have?

“The District Court exceeded its authority today when it barred the President from instructing his cabinet members to enforce existing law,” a Department of Justice spokesman said in a statement. “The Justice Department will vindicate the President’s lawful authority to direct the executive branch.”

This is a problem we’re seeing with the Obama judges that Harry Reid rammed through. They were selected not for their scholarly reviews of the Constitution, but for pure political reasons. For all intents and purposes, they are usurping powers they are not entitled to. Fortunately, President Trump appointed Neil Gorsuch to the Supreme Court to replace Antonin Scalia, and he is a constitutional scholar.

Over the next few years it is anticipated that several more vacancies on the USSC will open up. President Trump is also appointing similarly minded people to the lower level courts. Sadly, we’re going to be dealing with the Obama Judges for a while.
