The Seditious Six, The next steps

Good day all. I recently posted about the Seditious Six and the treasonous cow “representing” my district, Maggie Goodlander. Now the fallout of their video has started to land. I noted that the Department of War was looking into their actions. I commented that I didn’t see how the UCMJ could be used against these idiots. Well, it looks like at least one could be covered by the Uniform Code of Justice.


When I wrote the last post, I knew that all of those seditious losers had served in the military, including Maggie Goodlander. What I didn’t know was that Senator Mark Kelly, (Commie-AZ), had actually retired and was collecting a military pension.

I have asked about this from a retired military officer who was also a lawyer, (Civilian), why he didn’t really slam Biden and Obama. (Who he truly despised) He replied that since he was retired and taking a pension, he could, theoretically, be recalled to active duty and court-martialed.

I don’t recall the specific section he quoted from the UCMJ, but I believe it dealt with insubordination and misconduct. I will let those who have actual knowledge correct me and leave comments. (These are things I like learning about) In any case, this is what may be under consideration regarding Mark Kelly. Here are the details from Fox News:

The Department of War announced Monday that it has opened a formal review into allegations of misconduct against Democratic Sen. Mark Kelly of Arizona over a video calling on service members to “refuse illegal orders.” The Pentagon said it may even call Kelly, a retired Navy captain, back to active duty to face court-martial proceedings or other administrative actions under the Uniform Code of Military Justice. 

“This matter will be handled in compliance with military law, ensuring due process and impartiality,” the department said, adding that further comments will be limited to protect the integrity of the proceedings.

I’m surprised they made any comments at all. I’ve been trying to determine if and when this has happened in the past. I’ve found only a handful. According to Grok.com, less than 40 have been recalled in these circumstances since the 1950’s. The ones Grok listed were true scum with a few who should have been sentenced to death by wood chipper. (They hurt children)

The statement also underscored that military retirees remain subject to the UCMJ and reminded servicemembers that “orders are presumed to be lawful” and must be obeyed. The department cited federal statutes, including 18 U.S.C. § 2387, which prohibits attempts to undermine the loyalty, morale, or discipline of U.S. forces.

That law is part of the civilian code, not the Uniform Code of Military Justice. Civilians are not subject to the UCMJ and in those cases when they run afoul of the military, (Such as idiots breaking into a base to do something stupid), they are handed over to civilian law enforcement authorities.

“The Department of War reminds all individuals that military retirees remain subject to the UCMJ for applicable offenses,” the statement read. “A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”

Such recalls are rare and typically reserved for serious criminal conduct, such as espionage, sexual assault, or fraud. Still, precedent exists. In United States v. Dinger (2018) and United States v. Larrabee (2020), military appellate courts reaffirmed that retirees receiving pay remain under the UCMJ’s jurisdiction and can be tried for offenses committed after retirement.

The cases I found covered things like murder, rape and child molesting. I assume that calling on active duty members of the military to ignore orders, while not to the level of rape and murder, is pretty serious in and of itself.

If the review concludes that Kelly’s comments constituted conduct “to the prejudice of good order and discipline” or a violation of U.S. code, which prohibits encouraging disloyalty or insubordination among the armed forces, he could face recall to active duty for a formal court-martial.

Of course, if Kelly were recalled and put on trial, it will open a whole can of worms. One of these is the 1st Amendment and freedom of speech. Now if the Seditious Six had made their comments while on the floor, they would have been protected by the Debate clause in the Constitution.

This is what that loudmouthed ambulance chaser did when she accused the EPA chief of taking donations from Jeffrey Epstein. The problem was, it was the wrong Jeffrey Epstein. This was a Doctor Epstein she slandered, and he the donation happened after the criminal Epstein was silenced committed suicide. Since she made these accusations on the floor of the house, Dr. Epstein has no recourse in the courts.

As for recalling Kelly and charging him, the usual idiots on the Left in Congress are, once again, issuing threats. Here are those details from Fox News:

Sen. Ruben Gallego, D-Ariz., warned military members Monday that “there will be consequences” if they allowed Sen. Mark Kelly, D-Ariz., to be court-martialed.

Gallego reacted to the Department of War’s announcement earlier that day on X that it launched a formal review into allegations of misconduct against Kelly, a retired Navy captain, over his role in a controversial video urging service members to “refuse illegal orders” from President Donald Trump.

Gallego told CNN’s Kasie Hunt he has faith in the U.S. military and the justice system to handle the case properly, adding that officers know there would be fallout if they tried to “railroad” Kelly.

“Donald Trump is going to be gone in a couple of years,” Gallego said. “And if you’re part of the military that is going after sitting senators, sitting members of Congress, and part of the weaponization of government, there will be consequences, without a doubt.”

In other words, if the military actually does recall Kelly, and it does court martial him, and the evidence proves that he violated the laws and regulations and convicts, him, the Democrat party will go after everyone involved. Good thinking stupid. You have just announced that Democrats are above the laws everyone else is bound by. I don’t know, but this sounds like this is rather illegal to me.

He added, “I think there’s going to be a lot of officers that will be part of this potential tribunal, if they want to call it that, that will be looking over their shoulders. Because they know that Donald Trump will be gone and they will not have that protection. They’re going to have to do the safest thing possible, which is follow the Constitution of the United States, and you’ll be fine.”

Now that looks like he’s outright threatening retaliation against any officer who would be called to sit on a court martial board. I don’t think that’s going to go over to well with the military.

Gallego defended the video featuring Kelly and five other Democratic lawmakers, saying he has heard from military officers “concerned” about the president’s actions.

Yeah, sure he has. I know that there are a number of political officers, those who play politics to get ahead instead of preparing to defend the country, who have been having “attacks of the vapors” over President Trump doing things like cleaning up the mess left behind by both Obama and Biden. Currently, those officers are being pushed out the door.

“Also, you’re just seeing things that aren‘t very normal,” Gallego said. “You have the Marines who are walking around Los Angeles. You have National Guardsmen coming from different states into other states, even though those governors did not request that. You have a politicization of the military, that has never been seen before until this president has done it. And then, you also hear the president saying things that are, on its face, illegal.”

Sadly, these deployments have proven needed thanks to the Democrats. What this person isn’t saying is what the Guard is actually doing. What they aren’t doing is acting in a law enforcement role. They are defending federal property against attacks by the Democrats terrorist wing, Antifa. The are taking over from Federal law Enforcement Officers who are then going out and picking up actual criminals, illegal aliens, (Who are criminals), and basically doing what they’re supposed to do. Not having to protect the Federal facilities has been a problem. They’ve been overstretched.

He also cited Trump’s recent strikes against Venezuela without offering Congress information, though he did not refer to them as “illegal.” Gallego reminded people that they did not have to follow “illegal orders.”

Well, I think we found yet another member of congress who is upset that the price of his cocaine has been going up. I wonder if he’s also on the Cartel’s payroll as well. There are rumors and conspiracy theories that the Cartels have made some significant inroads into the Arizona state government. I can’t say that any of this is true of course.

Now I have no idea of Kelly will be recalled. I do know that Maggie Goodlander’s polling numbers have started cratering and that Lily Tang Williams is now neck and neck with that carpetbagging communist. This is just another move by the Democrats to try and gain absolute power and destroy all of their enemies, which amounts to more then half the country.

The Democrats, instead of pulling back, are doubling down on what amounts to insurrection, Seditious Conspiracy and potentially flat out treason. Once again, I’m going to say they are trying to start a second American civil war. They really believe that if it happens, they will win.
