Good day all. Once again, one of the more corrupt members of Congress is trying to avoid going to prison. Recently, a referral to the Department of Justice was made regarding Eric Swalwell for potential mortgage and tax fraud.
The DoJ has opened an investigation. If things go they way they have been in these cases, it looks like Swalwell will be the next to be charged. However, Swalwell has decided that he should sue to stop the investigation. Here are the details from Politico:
Rep. Eric Swalwell on Tuesday, November 25th, filed a lawsuit against Bill Pulte, accusing the director of the Federal Housing Finance Agency of violating the Privacy Act and First Amendment in order to refer the California Democrat to the Justice Department.
The suit, filed in a federal court in Washington, alleges that due to Swalwell’s criticism of President Donald Trump, Pulte began “scouring databases at Fannie Mae and Freddie Mac” in order to acquire Swalwell’s private mortgage records. This, the suit argues, violated the First Amendment’s “bedrock prohibition on viewpoint-based retaliation.”
Oh good luck with that one. The case, if the investigation concludes that there is evidence of a crime, has nothing to do with the 1st Amendment. It has everything to do with the Democrats thinking that they are above the rules and laws they impose on everyone else.
Swalwell — who recently announced a gubernatorial bid — accuses Pulte of doing the same to other politicians who have caught Trump’s ire, including New York Attorney General Letitia James, Federal Reserve board member Lisa Cook and Sen. Adam Schiff (D-Calif.).
“Director Pulte has combed through private records of political opponents. To silence them,” Swalwell said in a statement. “There’s a reason the First Amendment — the freedom of speech — comes before all others.”
The investigation into Schiffhead’s potential mortgage fraud is still ongoing. Even though a corrupt COB judge has dismissed the charges against Letitia James, they were dismissed without prejudice, meaning they can be refiled. Considering all the evidence they have, the charges against James will probably be refiled next week. I don’t know how Mr. Pulte is going about reviewing the paperwork, however, his auditors are finding things.
Earlier this month, Pulte referred Swalwell to the Department of Justice for a potential federal criminal probe, alleging that Swalwell had engaged in mortgage and tax fraud related to a home in Washington.
Swalwell’s complaint argues that the referral has harmed the Democrat’s reputation “at a critical juncture in his career: the very moment when he had planned to announce his campaign for Governor of California.”

It is impossible to harm Swalwell’s reputation. He is lucky he isn’t being charged with espionage. As to the referral being done because Swalwell announced his campaign for Kalifornistan governor? Hello? Swalwell made that announcement AFTER the referral. Of course, IF Swalwell should end up in the right court, he might get his wish. Sadly, it appears that once again, Judge James Boasberg has somehow gotten his hands on a case that he can interfere with. Here are those details from the Washington Times:
Judge James Boasberg, who has stood out as one of President Trump’s chief judicial adversaries, is overseeing Rep. Eric Swalwell’s lawsuit challenging allegations he committed mortgage fraud.

The lawsuit, filed in federal court in Washington on Tuesday, takes on William Pulte, director of the Federal Housing Finance Agency, who has flagged alleged mortgage fraud by Mr. Swalwell and other of Mr. Trump’s political foes. The case was assigned to Judge Boasberg on Wednesday, according to the docket.
It’s amazing just how many cases that somehow end up in this Judicial thug’s court that allows him to rule against the Trump Administration, regardless of the evidence, the law or the Constitution. There is a reason that Congress is considering whether or not he should be impeached.
Judge Boasberg’s rules in the case have the potential to impact other mortgage fraud cases initiated by Mr. Pulte, including cases against Federal Reserve Governor Lisa Cook, New York Attorney General Letitia James and Sen. Adam Schiff of California.
This makes me think that Boasberg is already working on his ruling even before the case is has been heard.

In his lawsuit, Mr. Swalwell alleges that Mr. Pulte, in referring him to the Department of Justice for mortgage fraud charges, violated the Privacy Act of 1974 by going through private — not public — records of his Washington home purchase. The Privacy Act of 1974 is aimed at protecting citizens’ private information from political adversaries.
I took a quick look at the Privacy Act of 1974 on that site of absolute unbiased information, Wikipedia. Ok, you can stop laughing now. In some cases, they do manage to provide actual, useful information. In this case, they list the exceptions to the law. According to Wikipedia, and I think they’re just quoting the actual law. There are exceptions. The one that will be waved in the face of that jerk Boasberg is the part that says “For law enforcement purposes.”

With regards to Letitia James, a lot of the information of her criminal activities came out from private citizens who checked public records. There was enough there to have the administration take a look to see if there was any fire associated with all the smoke they were seeing. It turns out, there was and they are still finding things.
We have no further information on the investigation into Schiffhead’s alleged fraud, which is as it should be. The DoJ investigators should only release information that they are required to under the law. For all we know, they’ve looked into it and found that Schiffhead made technical errors and not intentional fraud. Now if this were Schiffhead and he was investigating President Trump, he would be blasting out everything he could, whether it was real or not.

I have a sneaking suspicion that Swalwell did do what they think he did, he knows he’s guilty as sin and is trying to throw anything against the wall in hopes it will stick and save his crooked butt. Since Boasberg has managed to get his hands on this case, I full expect that he will rule against the administration and order the criminal investigation to stop. If he does, then the time has come to forget about impeachment and move right to criminal indictment.
