Janus ruling, Phase II

Good day all. Last June, the Supreme Court handed down what has become known as the Janus Ruling. The short version of the ruling is that it stops unions from forcing nonmembers to pay the unions for “Representing” them. These are called Agency fees.

Another term for them would be extortion payments. Due to the way Unions locked down work environments, if you weren’t paying the Union, you flat out were not allowed to have the job. The Unions then took that money and used it to buy votes from the CommuNazis that benefited the Union’s leadership. (Rarely did it actually help the rank and file)

Finally, nonmembers had enough and sued. Last June, they won. When the ruling came down, Nonmembers started demanding their money back. The Unions and some of the state governments that the Unions own basically are ignoring the court’s ruling. Now, Phase II is starting up. Victims of the Unions thievery are now suing the unions for their money. Here are the details from Fox News:

Despite the landmark Supreme Court ruling this summer barring public-sector unions from requiring nonmembers to pay so-called agency fees, workers in several states say unions are either flat-out ignoring the decision or establishing a frustrating maze of procedural roadblocks to avoid compliance.

The June decision in Janus v. AFSCME sent shockwaves through organized labor in the U.S., holding not only that public unions violated the First Amendment by taking money out of unwilling workers’ paychecks to fund collective bargaining, but also that employees must “clearly and affirmatively consent” before any fees or dues are collected.

Many people, when given the chance, run, not walk away from Unions. They know that Unions do not represent them, only the union leadership and the Progressive political class. When Wisconsin got rid of mandatory unionism for government jobs, several locals closed. Why? The only members were the actual union officers and administrators. The “Members” flipped them the bird and left, along with their money.

Janus could end up costing unions hundreds of millions of dollars in California alone, where workers who filed an earlier suit say the case should apply retroactively, alleging that the Service Employees International Union (SEIU) retained members not through their “clear” consent, but through convoluted and difficult “opt-out” procedures. The nation’s largest union, the 3-million-member National Education Association, announced plans to cut nearly $40M from its budget after Janus, amid fears it would lose hundreds of thousands of members.

It isn’t just the membership losses that terrifies the Union leadership, it’s also the CommuNazi Party. For almost a century, they’ve relied on coerced union dues and forced “Support” to get into and hold office. If the Unions can’t hold on to their slaves members, then they become irrelevant to the CommuNazi Party. In short order, the old line unions will collapse and fade away.

Faced with those challenges, workers’ rights advocates say some unions and state governments have decided to effectively defy the Supreme Court.

“We’re seeing huge problems across the country,” Diana Rickert, the vice president of the Liberty Justice Center, which represented the plaintiff in the Janus case before the Supreme Court, told Fox News. “There is almost no government in America that is fully complying with the Janus ruling.”

She said this includes unions not seeking “clear” consent with members as prescribed by Janus, or even using intimidation tactics to keep members on the rolls.

This isn’t at all surprising. Unions are, at their core, Soviet style communist organizations. They have their “Ruling Elites,” their “Commissars,” and their “Secret Police.” It’s the latter group that likes to go out and assault anyone who stands up to the unions. In the olden days, beating a recalcitrant worker or member was standard practice. In a few cases, said recalcitrant worker may have been murdered “Pour encourager les autres.” It’s no surprise then that the unions and their flunkies in the blue states are ignoring the court decision.

“What we’re up against is a national manipulation campaign led by government unions who want to stand in the way of workers exercising their rights,” Rickert said. “Government union officials across the country are trying to scare and intimidate people into maintaining membership by making threats – they say things like, ‘Your salary will go down if you leave the union’ or ‘You’ll lose your benefits.'”

In other instances in states including California and Minnesota, Rickert said, workers have been told they can only leave unions at some specific window in the future.

That was allegedly the case in Washington state, where several workers sued the government last month after being told they would have to wait until an “escape period” next year to leave their union. The Washington-based conservative Freedom Foundation brought the case against the Washington Federation of State Employees, saying it had “pressured” and misled employees.

I suspect that “Escape Period” will be during a full moon in the months of February at between the hours of 11:59:50PM until 11:59:59PM. If you miss that window, so sad, to bad, pay up.

For their part, unions have denied any strategic effort to defy the new Supreme Court decision.

“SEIU’s local unions are in compliance with the Supreme Court directives in Janus,” SEIU spokeswoman Sara Lonardo told Fox News. She added that the California suit against the SEIU local union there “lacks merit.”

But in a statement shortly after the Janus decision, Greg Kelley, president of SEIU Healthcare Illinois Indiana Missouri & Kansas, presaged the ongoing fight against the ruling.

What the court and these groups don’t realize … is that workers will not be deterred by such rulings and will continue to organize and unite to win fair wages and benefits while also providing the care and services that taxpayers want and deserve,” Kelley said.

Dear Dumbass. Now on is saying you can’t organize. What you fail to understand is that you no longer have the ability to loot and pillage nonmembers paychecks so that you and the other members of the Union Elite can have your 6 and 7 figure paychecks.

There are signs the fight may not be over soon. Some legal experts, including UCLA Law Professor and First Amendment scholar Eugene Volokh, have suggested that states might be able to perform a constitutional end-run around Janus by directly funding unions using general tax revenues, rather than taking funds directly from individual workers’ paychecks. Officials in some states, including Hawaii, have floated measures along those lines, which Rickert said would lead to additional legal challenges grounded in the same fundamental principle.

Oh that idea is going to go over well with the taxpayers. However, since the morons floating these ideas are in states controlled by the CommuNazi Party, what the taxpayers want has no bearing on their decision to loot the treasury and give the money to their union masters.

“This case is about giving workers a choice and a voice,” Rickert said. “Not tricking, intimidating or coercing people into union membership.”

Not according to the unions or their bought and paid for politicians. They refuse to believe that any individual has the capacity to make their own decisions. Only the over educated ruling elite can make decisions for the “Working class” and if they know what’s good for them, they will shut up and follow orders…or else.

The CommuNazi Party believes in mandatory union membership. They want to force everyone into a union no matter what their feeling about being a member are. If you listen to the screeching coming out out the party’s leadership, you can see where we will be going if they get their way.

For all intents and purposes, the 13th Amendment will be repealed. A goal the CommuNazis have been working towards since they lost the Civil War and had to give up their slaves. This time, it won’t be those of recent African decent who are put back into chains, it will be everyone.
