IG Report rips James Comey a new one

Good day all. The Inspector General’s report on former FBI director James Comey has come out and it hammers Comey over his handling of sensitive documents. In this case, it was the memos he leaked to the press to “Get Trump!”

The report was covered somewhat by the Mostly Stupid Media, but with the news regarding Hurricane Dorian, it’s slipped off the radar to some extent. What has been interesting is how the IG’s report was covered. The Democrat Propaganda Ministry, formally the Main Stream Media, basically buried the report. Here’s what CBS News had to say:

An independent watchdog found that former FBI Director James Comey did not release classified information to the public, although he did violate agency policy by taking home unclassified memos and ensuring that they would be leaked to the press.

As I understand it, the Inspector General relied on the classification levels provided by the Department of Justice. Still, the report was not kind to Comey.

The inspector general said in an 83-page report that Comey “violated applicable policies” related to his FBI employment agreement and that the memos were official FBI records. The probe found that the memos Comey leaked contained confidential, but not classified, information.

As you can see, CBS News chose to “Cherry Pick” the best possible results from the report. While they didn’t lie, they did obfuscate the truth. In a report from that noted conservative web site, The Hill, the IG actually recommended that Comey be criminally charged.

Inspector General (IG) Michael Horowitz’s team referred Comey for possible prosecution under the classified information protection laws, but Department of Justice (DOJ) prosecutors working for Attorney General William Barr reportedly have decided to decline prosecution — a decision that’s likely to upset Comey’s conservative critics.

When I read that AG Barr had decided not to prosecute, I was a tad upset, but then I recalled that another investigation is currently underway that could put Comey and the other conspirators away for a very long time. Still, I think he should have been perp walked to the court house.

Prosecutors found the IG’s findings compelling but decided not to bring charges because they did not believe they had enough evidence of Comey’s intent to violate the law, according to multiple sources.

Oh I think Comey knew what he was doing was illegal. He just didn’t care. Why? He literally believes that he is above the law and can do no wrong. Still, I can understand where they might not want to waste resources on this.

Although a technical violation, the DOJ did not want to “make its first case against the Russia investigators with such thin margins and look petty and vindictive,” a source told me, explaining the DOJ’s rationale.

Yeah, he probably would have been fined, nothing more. Another reason they might want to hold back is the other investigation now underway by the U.S. Attorney in Connecticut.

But Comey and others inside the FBI and the DOJ during his tenure still face legal jeopardy in ongoing probes by the IG and Barr-appointed special prosecutor John Durham. Those investigations are focused on the origins of the Russia investigation that included a Foreign Intelligence Surveillance Act (FISA) warrant targeting the Trump campaign at the end of the 2016 election, the source said.

There are significant issues emerging with how the FISA was handled and other conduct in the investigation, and everyone involved remains under scrutiny,” a second source said.

The FISA warrants that were granted turned out to be based on the thoroughly discredited “Steele Dossier” that basically said that President-Elect Donald Trump was working for the Russians. By the time of the first FISA request, it was well known in the Justice Department that the dossier was a load of garbage.

Comey and the other conspirators lied to the FISA judges to get and renew the wiretap warrants. This answers the question of why no charges. Why go for the “Slap on the wrsit” convictions when you can get so much more? Even President Trump, who was a victim of Comey’s misdeeds approved of the decision not to prosecute Comey. According to Fox News:

President Trump said Friday that James Comey is “lucky” that Attorney General Bill Barr did not prosecute him, claiming the “disastrous” Justice Department inspector general report released this week exposed an illegal scheme to strip away his and his supporters’ rights.

The fact that James Comey was not prosecuted for the absolutely horrible things he did just shows how fair and reasonable Attorney General Bill Barr is,” Trump tweeted on Friday. “So many people and experts that I have watched and read would have taken an entirely different course. Comey got lucky!”

Notice how President Trump doesn’t land on Attorney General Barr. I have no proof, but I would not be at all surprised if Mr. Barr didn’t talk to President Trump first and lay out his reasons for not charging Comey. President Trump is also fully aware of what U.S. attorney John Durham is looking into how this whole Russia investigation got started. According to Real Clear Politics:

Former U.S. Attorney Joe diGenova said it was “very obvious” that the FBI and DOJ under President Obama tried to “frame” Donald Trump and “defrock him” to prevent him from taking office. DiGenova called for accountability from disclosure to possible prosecution if malicious intent and FISA warrant abuse can be proven.

“Comey’s not out of the woods,” DiGenova told FNC’s Laura Ingraham on Thursday. “He is a target along with a number of other people of a major criminal conspiracy investigation by John Durham. It doesn’t mean he is going to be charged but he’s right in the middle of the grand conspiracy that John Durham is investigating. I applaud what Bill Barr did in not bringing this case.”

I’m not a lawyer, and I don’t pay one on TV. However, I’ve heard from other lawyers as well as informed people on the possible charges that could be brought against Comey and the others. Starting at the low end, we would have conspiracy, since they all talked about doing this, then we move up to perjury, both to the courts and congress. After that we start getting into the really serious stuff.

Another charge that could be brought against the conspirators would be criminal civil rights charges. They used their offices to willfully violate the civil rights of President Trump, Carter Page and a number of other people in the campaign and transition team. Next up the chain, although I can’t say it’s likely, would be sedition.

The main page at the Cornell Law web site lists a number of sections. The ones I think might be applicable, in my unschooled opinion, would be 18 U.S. Code §?2384. Seditious conspiracy and possibly 18 U.S. Code §?2385. Advocating overthrow of Government. The first one, Seditious Conspiracy would seem to fit. Here’s what the law states:

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

This one might be a stretch, but the hatred for Donald Trump and the activities to cover up the real crimes of Felonia von Pantsuit could be construed as trying to overthrow the duly elected government of the United States. The one charge we can’t consider, sadly, is Treason. While the actions of Comey, Clapper, Brennan and the others would meet that criteria in pretty much any other country, the United States is unique in specifying exactly what treason is in the Constitution.

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

As you can see, this charge doesn’t fit, so we can’t take them all out and hang them. Still, with a little bit of luck, some good and honest investigations and the will to “Do the right thing”, there is a very good chance that Comey will die in prison.

I’ve heard rumors that one other reason they chose not to prosecute Comey is that a number of lower level conspirators might be negotiating with Durham’s office to testify against the others in exchange for immunity or leniency. If this case is as bad as it seems, who knows where it could lead? Into the Oval Office of the previous administration perhaps?
