Ulvalde survivors suing law enforcement

Good day all. Last May, a psycho got into a school and murdered innocent teachers and students. As bad as that was, the police response is considered to be an object lesson in exactly what not to do. Responding officers, instead of heading in to confront the criminal, waited outside.

Only one officer made any move to charge the criminal, (His wife was in the building), and he was stopped by the other officers and disarmed. Several unarmed civilians also attempted to breech the school to rescue their children and any others they could. They were arrested by the gutless wonders of local law enforcement. Finally some federal officer said “The hell with this, went in and blew away the criminal.

In the fallout after this debacle, a number of law enforcement officers were fired, reassigned or resigned. Now yet another shoe has dropped. A law suit has been filed by the survivors and families of the rampage. Here are the details from the Post Millennial:

Survivors and the families of victims from the massacre at Robb Elementary School in Uvalde, Texas on May 24 that saw 19 children and two teachers killed have banded together to file a $27 million class action lawsuit against several law enforcement groups over their failures that day.

CNN reports that the lawsuit was filed Tuesday and said, “Instead of swiftly implementing an organized and concerted response to an active school shooter who had breached the otherwise ‘secured’ school buildings at Robb Elementary school, the conduct of the three hundred and seventy-six (376) law enforcement officials who were on hand for the exhaustively torturous seventy-seven minutes of law enforcement indecision, dysfunction, and harm, fell exceedingly short of their duty bound standards.”

The Post Millennial story goes into the details of what happened and how the Ulvalde police and other law enforcement agencies flat out botched the job. What I’m concerned with is how this suit is going to carry the day. There are a number of United States Supreme Court decisions regarding police screwing up like this and none have come down in favor of the plantiffs.

The short version has always been that the police are not there to protect you, but to protect “Society.” That’s a very short and not entirely accurate description, but it’s the jist of what the courts have said over the last 100+ years. People have sued when they called the police and they didn’t show up, or showed up long after the crime was committed. Who knows though? Perhaps the USSC will review their precedents and rule in favor of the plaintiffs this time.
