Good day all. Last year a Pro-Life activist was arrested by the Department of of (In)Justice for allegedly violating the FACE Act. Mr. Houck was tried and acquitted, with the acquittal coming fairly quickly. It was shown that Mr. Houck was not blocking the entrance to the clinic, (He was a block away), and was defending his son from a thug who came after them.
The whole action against Mr. Houck and his family was yet another demonstration of the weaponization of the DoJ. The Federal Prosecutors knew that Mr. Houck had committed no crime, but they chose to try and railroad a man they knew to be innocent. Now Mr. Houck is going after the DoJ. Here are the details from the Daily Signal:
Pro-life activist Mark Houck and his wife, Ryan-Marie Houck, are suing the federal Department of Justice over the DOJ’s treatment of their family, accusing the DOJ of a “faulty” investigation that led to an excessively forceful arrest and a “malicious and retaliatory prosecution” that has severely impacted their entire family.
Faulty investigation? How about no investigation? The local police looked into the incident when it happened and came to the conclusion that Mr. Houck was guilty of only defending his son from a Progressive Liberal Pro-Abortion nutjob. When the Feds went after Mr. Houck, they sent in a 20 man Swat team and basically acted like a Police State goon squad.
Houck is a Catholic father of seven who was arrested and charged with violating the Freedom of Access to Abortion Clinic Entrances, or FACE, Act by President Joe Biden’s administration. A jury found him not guilty of the federal charges in January, and he announced in August that he is running for Congress in Pennsylvania’s 1st Congressional District.
Now the Daily Signal gets to the “Meat of the matter.”
The DOJ’s FACE Act charges stemmed from a 2021 incident outside a Philadelphia-based Planned Parenthood where Houck pushed an abortion clinic volunteer who was repeatedly harassing his son, Mark Jr. Local authorities ultimately dismissed the matter—until the Biden DOJ re-upped it in response to the overturning of Roe v. Wade.
If I recall correctly, there was video of the incident which the local police reviewed. It was this footage, along with other details that led them to decide that Mr. Houck was only defending his family from a dangerous Progressive fanatic. The DoJ had the exact same evidence. They just ignored it.
Mark and Ryan-Marie Houck believe they were targeted by the Biden DOJ in an effort to intimidate, silence, and scare the family for their pro-life work—praying outside abortion clinics for the women headed inside to abort their unborn babies.
Unlike England, it’s perfectly legal to pray outside a clinic as long as you don’t block the entrance. (There are a lot of constitutional questions that need to be asked and answered regarding the FACE Act too)
“This lawsuit will send a strong message to the DOJ that the United States of America does not belong to [Attorney General] Merrick Garland or the FBI; it belongs to all Americans, despite our many disagreements on different issues,” said Shawn Carney, president of the pro-life organization 40 Days for Life, which is representing Houck. “We all believe that we should have the right to free speech and be protected from unlawful infringement by our own government.”
Only if you can strip the people involved of their limited immunity and make them personally liable for their actions. That is virtually impossible. (It shouldn’t be. Holding some of these corrupt prosecutors personally accountable will do a lot to correct problems we now have in the Justice system)
He added: “Mark and his wife have valid and critical claims against the government that raided their house and pointed guns at them and their screaming children. Mark, his wife, and their seven children have been devastated by this horrific event, which should never have happened if not for the bigotry of our compromised DOJ.”
The FBI has been pulling this stunt, sending in heavily armed, militarized SWAT teams for a number of years against people who aren’t violent and aren’t any sort of threat. Mark Houck’s suit describes this arrest as an “unnecessary and unlawful show of force,” accusing the agents of intentionally seeking to assault him and deprive him of his Fourth Amendment rights “by using excessive force to arrest him on non-violent charges when he had not threatened law enforcement, did not own a gun, and had offered to turn himself into authorities if indicted.”
The DoJ flat out didn’t care about any of this. Their goal was to make an example of Mark Houck and, if the opportunity presented itself, summarily execute him. The Daily Signal goes into the psychological and physical toll take on the entire Houck family by these thugs with badges.
Ryan-Marie Houck is seeking $3.25 million in damages for herself and for her children. Mark Houck seeks $1.1 million for malicious prosecution, retaliatory prosecution, false arrest, abuse of process, and assault.
I think she’s low balling the damages, unless they will be asking for punitive damages as well.
Carney, president of 40 Days for Life, emphasized to The Daily Signal that “the harassment from the DOJ toward 40 Days for Life volunteers, including Mark Houck and his family, has been the most extreme example of government overreach in decades.”
“Everyone in our nation can see the blatant bigotry the DOJ has shown toward pro-life Americans and Catholic Americans, but many feel helpless to do anything about it,” he said. “Mark Houck is one man who can, and thank God he is willing to, stand up to this radical government overreach and abuse of power.”
Mr. Houck is running for the House of Representatives in 2024. As to whether or not he can win, I can’t say. I don’t know his district. Without question, the progressives Liberals and Democrats will hit him on his abortion stance, but that could backfire considering the abuse he suffered at the hands of the Biden/Garland Do(I)J. As to his lawsuit?
While I would love to see it succeed, the DoJ will fight it tooth and nail and make sure that it ends up in front of a Biden or Obama judge. Perhaps of Mr. Houck becomes Representative Houck, he can put forward a bill to disband and abolish the Federal Bureau of Investigation. Thanks to stunts like this, easily half the American People want that agency closed and the personnel fired. Hopefully we will see a win on both paths.
