Good day all. During the January 6th protest, Ashli Bennitt was murdered by a Capitol Police lieutenant who fired on her without warning or justification. That trigger happy fool almost hit Washington Police officers who were right behind Ms. Bennitt. Of course, that fool was promoted and the entire issue broomed by the Democrats.
A wrongful death suit was filed by the Babbitt family against the government in federal court in California. Recently, the Garland Do(i)J has filed a change of venue from California to Washington. Here are the details from the Post Millennial:
The Department of Justice has filed to change the venue of Ashley Babbitt’s wrongful death lawsuit from California to Washington D.C. A hearing on the request is scheduled for April 8 in San Diego. US District Judge Cynthia Bashant, an Obama-appointing, is overseeing the case. Babbitt was shot to death by Capitol Police on January 6, 2021 as she was attempting to enter the Capitol Building. She was unarmed.
What happened is a bit more involved then that. The upshot is that the shooting was flat out unjustified and that “Police officer” should have been prosecuted. Instead, the Democrats rewarded him with a promotion. Since the family isn’t able to get the justice they deserve, (That cop jailed for life), they have been moving through the system in civil court.
Judicial Watch filed a lawsuit in the U.S. District Court for the Southern District of California on behalf of Babbitt’s family, seeking justice for the tragic death of the veteran, who was shot and killed by Capitol Police Lieutenant Michael Byrd on January 6 in the U.S. Capitol.
Outlined in Judicial Watch’s complaint, the shooting took place at the east entrance to the Speaker’s Lobby, where Babbitt was unarmed and had her hands raised when she was fatally shot by Lt. Byrd. The complaint highlights Byrd’s admission that he shot Babbitt without assessing her intentions or identifying her as female.
Part of this case is that there were police officers from the Washington Police SWAT team right there. They were literally within arms reach of Ms. Babbitt and that trigger happy coward almost hit them. They were not happy and the team leader believed that Byrd should have been prosecuted.
In March, Judicial Watch filed an opposition to the Justice Department’s request to transfer the venue of the case to the District of Columbia. The organization pointed out that under federal law, a “civil action against the United States may be brought in any judicial district in which the plaintiff resides,” and “a civil action on a tort claim against the United States may be prosecuted in the judicial district where the plaintiff resides.”
Obviously, the Deep State, The Biden Maladministration, Merrick Garland and the Democrats can’t have that! Why it’s possible that the federal courts out west might actually look at the law and the facts, something the Washington D.C. federal courts routinely ignore.
Judicial Watch contends that Washington D.C. is a “hostile forum for January 6 defendants” and is already prejudicially biased against Ashli Babbitt. They argue that moving the case to D.C. could potentially undermine the pursuit of justice for Babbitt’s family, leading to an unfair legal outcome.
If you haven’t figured it out yet, that is the intent of the filing. Obama and Dingy Harry Reid stacked the United States District Court for the District of Columbia with doctrinaire progressives who have shown utter contempt for the Constitution and the Rule of Law. This is the court that has been railroading people into jail for just being in Washington on January 6th.
Garland and the Do(i)J know that any case brought by the family will be almost immediately thrown out. The only potential hiccup is if it lands in front of one of the few Trump judges, and you know they will make sure that doesn’t happen. I can’t say what will happen here or what the chances of the case being moved. I do know that until the Greatest President of the 21st Century is returned to office in January, 2025, the massive injustices will continue. On the flip side, Byrd might find himself indicted and facing justice. There is no statute of limitations on murder. We shall see what happens of course.
