Good day all. I recently posted about President Trump ordering troops deployed to Portland, Oregon to protect the federal facilities basically being attacked by Antifa and other Leftard terrorist wannabes. As you would expect, the city and state governments are unhappy that soldiers are being deployed, apparently with orders to use whatever force is needed to protect themselves, other Federal agents and the federal facilities in question.

I mentioned in the post that the city and state would soon be running off to find another Obama or Biden judge to issue an illegal order forbidding President Trump from sending in the military. Right on schedule, the moonbats and communists have done just that. Here are the details from Fox News:
The state of Oregon filed a lawsuit Sunday to block President Donald Trump’s plan to deploy 200 National Guard troops to Portland.
The suit was announced by Oregon Attorney General Dan Rayfield within hours of Gov. Tina Kotek receiving a memo from Department of War Secretary Pete Hegseth, in which he authorized the troop deployment for 60 days.
According to the order seen by Fox News Digital, the federally controlled Oregon National Guard would be stationed in Portland to protect federal property “where protests are occurring or likely to occur.”
What this means is that those troops have been federalized and are considered active duty military forces. They are no longer under the command of the Governor of the State of Oregon.
Kotek, Portland Mayor Keith Wilson, and Rayfield, all Democrats, responded by jointly filing the challenge in federal court, arguing the administration’s move is “unlawful” and unnecessary.
“Oregon communities are stable, and our local officials have been clear: we have the capacity to manage public safety without federal interference,” Rayfield said in a statement.
First, the city and state have no standing. Second, the courts have no authority on how, when and where the United States deploys the military. Third, the DoJ lawyers will simply present videos of all the riots, assaults and damage being done by Antifa along with the lack of police response when requested.

Kotek also said Saturday she had spoken directly with the president before Sunday’s order and had urged him not to send in troops.
“Our city is a far cry from the war-ravaged community he has posted on social media,” Kotek told reporters at a news conference at Tom McCall Waterfront Park.
“There is no insurrection, there is no threat to national security and there is no need for military troops in our major city,” she added.
The War Department and the Trump administration ignored the City and State and the troops are now coming on site.
Despite those objections, federal agents began arriving in Portland over the weekend, with one clash already reported outside an Immigration and Customs Enforcement facility.
I need a bit more detail here. Did the morons attack the Federal Agents or did they do something really stupid and go after the soldiers?
Mayor Wilson condemned the arrival of National Guard troops.

“We did not ask for them to come. They are here without precedent or purpose,” he said.
Congratulations Mayor. You scored 1 out of 3 on the test. You failed. There is plenty of precedent going back to the founding of the United States. They also have a purpose. It’s not the purpose I would prefer, but they do have one. It’s to protect the federal facilities from the rampaging mobs, which you not only have failed to do, but have announced that you won’t do.
Sen. Jeff Merkley, D-Ore., urged demonstrators to avoid confrontations with federal agents. “Their goal is to create an engagement that will lead to conflict,” he said.
Again, some clarification is needed here. Is he referring to the rioters and Antifa thugs looking to create a confrontation or the National Guard and the Federal Agents? I can safely say that neither the Guard or the Federal agents have any interest in a confrontation. They would rather be back home knocking back a cold one, not dealing with these communist terrorists.
The lawsuit follows a similar case filed by California in June, after the administration sent troops to Los Angeles.
Oh goodie, they are reinforcing failure. The Biden judge, or was it an Obama judge? I don’t recall and can’t be bothered to look it up, has already been overturned.
“This will only serve to divide us as a nation and community under the guise of caring about public safety,” Rayfield said. “The number of necessary troops is zero.”
Nice try, but that divide is already in place and it’s people such as yourself who have caused it.
“As standing policy, the Department does not comment on active litigation. We have no comment on this nor the Oregon ARNG deployment at this time,” a Department of War spokesperson told Fox News Digital.
Allow me to provide some commentary for them.
I’m sure they will find some leftard Obama or Biden judge who has no problem ignoring the law and constitution. Most of them consider the law and the constitution to be advisory at best and something the just ignore at worst. I can just see one of those pinheads issuing an order canceling the federalization order and then commanding the National Guard troops to leave. Yes, they are that arrogant and stupid.
It won’t work of course. What it will do is further cement in most people’s minds that the judicial branch, at least the district and some of the appellate courts, can no longer be trusted to uphold the law and the Constitution. If this actually ends up in the Supreme Court again, I think that even Justice Roberts may decide it’s time to lower the boom. We shall see what happens next.

Once again a judge has asserted authority she does not have. Judge Karin Immergut, who is one of the few Trump appointees who were mistakenly nominated, has decided that the president does not have the authority to deploy troops to protect Federal property. Here are a few details from Fox News:
A U.S. District Court on Saturday issued a temporary restraining order (TRO) to halt the Trump administration from deploying 200 National Guardsmen to Portland, Oregon, amid violent anti-Immigration and Customs Enforcement (ICE) protests.
The lawsuit, brought by the State of Oregon and City of Portland, argued the deployment was unlawful, exceeding the president’s statutory and constitutional authority.

This has already been addressed by the Supreme Court in regards to the deployment of National Guard troops in Los Angeles. A judge out there issued the same order and was slapped down by SCOTUS.
Immergut ruled Saturday that Trump’s federalization order exceeded his authority because the law only allows the president to call in the National Guard under exceptional circumstances, including invasion, rebellion or an inability to execute federal law using regular forces.
The court found none of those conditions existed in Oregon, determining that local and federal law enforcement were capable of maintaining order.
Further, because Immergut ruled Trump acted outside statutory limits, she found the order also violated the 10th Amendment by infringing on Oregon’s sovereign right to control its own National Guard.
Obviously, this judge is not paying any attention to what is going on. Additionally, she has completely misunderstood the reasons for the deployment, probably intentionally. The Guard troops are not being deployed to handle law enforcement duties, they are being deployed to protect federal property and free up Federal agents to perform law enforcement duties. She also is ignoring the fact that the Portland Police have been ordered by the city government to basically stand down and not interfere with Antifa. Add to this the flat out attack on an ICE convoy in Illinois yesterday that resulted in shots fired, and it’s pretty obvious that this judge has her head firmly planted up her ass.
