Good day all. With the recent election and the landslide victory of the Greatest President of the 21st Century, Donald Trump, along with the GOP takeover of the Senate, Democrats are in a blind panic over the Supreme Court. In President Trump’s last term, he was able to appoint three Justices.
The three new justices basically flipped the court from the ideals of the Progressive Liberal Democrats, who have used the courts and their progressive justices as a super legislature, to the side of justices who are strict, generally Constitutionalists. A couple of years ago, the Democrats forced Justice Stephen Breyer, who was a consistent Progressive “Living Constitution” justice to retire. This was to prevent a replay of what happened with Ruth Bader-Ginsberg who finally croaked in office and allowed President Trump to appoint her replacement.
This caused a lot of thinking regarding Stephen Breyer, who is also no “Spring Chicken.” The Democrats were afraid that if he held on until another Republican became president, (Which has happened), then another Constitutionalist might be appointed and end the Democrats dreams of scrapping the Constitution for a generation. He caved in and Biden appointed Ketanji Brown Jackson, who is considered to be an idiot. (A typical Biden appointee in other words.
Now the Progressive Liberal Democrats, realizing that their worst nightmare has occurred, and Donald Trump is now returning to office with both a mandate and control of the Senate, are looking at Justice Sonia “Wise LatinXa.” She is not in good health and might not make it through another Trump administration. Their answer? Force her out while they still control the Senate. Here are the details from Fox News:
Democrats are reportedly discussing whether to call on Supreme Court Justice Sonia Sotomayor to immediately resign in an effort to avoid her replacement potentially being made under President-elect Trump, Politico reports.
The concerns stem from the possibility of Trump filling her seat if it becomes vacant during his presidency. However, with the former president taking office in just two months, any proponents of a quick turnaround replacement have a short window to act.
“She can sort of resign conditionally on someone being appointed to replace her,” a Democratic senator told Politico Playbook. “But she can’t resign conditioned on a specific person. What happens if she resigns and the nominee to replace her isn’t confirmed, and the next president fills the vacancy?”
Nice plan. Pity it won’t work. First, you have to convince Sotomayor to step down. While she’s not in the greatest of health, she’s not quite dead yet. Second, finding a replacement is going to take time even if you have someone in mind. Then comes the background investigation, and finally, the confirmation hearing. All that takes time and the current congress is coming up on adjournment.
The Democrat also told the outlet that there remain two top concerns about the idea: confirming a new justice under Congress’ already packed schedule and whether any members would be willing to go on the record against Sotomayor.
I have little doubt that there are hard left Democrats who are just fine throwing Sotomayor under the bus. The question is, do they have a majority? I don’t think they can count on Manchin from West Virginia, since he’s retiring. Arizona’s Sinema is also out. She probably won’t support this either.
Proponents of the idea would have to guarantee enough Senate votes to ensure a quick confirmation before Trump takes office, which, one source told Playbook, could face a potential roadblock from members such as retiring Sen. Joe Manchin, I-W.Va., if they do not support the replacement.
Manchin is just one roadblock.
This is all assuming that any nomination makes it out of committee before this congress adjourns. The Republicans will definitely slow things down, and any potential nominee is going to be asked some very tough, pointed questions, especially with who the Democrats are looking at as a replacement.
Those discussing a potential replacement for Sotomayor are already eyeing D.C. Circuit Judge J. Michelle Childs, who was appointed by former President Obama in 2009.
I think if the Democrats try to push an Obama judge on to the Supreme Court, especially with their penchant to ignore the Constitution, they are going to have one hell of a fight on their hands. As it is, they have 2 months before President Trump is sworn in and the new Congress takes office on January 3rd, 2025. You will also have the Thanksgiving and Christmas breaks, all of which burn up the time available to railroad a new Supreme Court pick.
The simple fact of the matter is, they aren’t going to get rid of Sotomayor unless she drops dead or is so incapacitated, she can’t perform her duties. The odds are that President Trump will be nominating her replacement, and if not him, potentially President J.D. Vance in 2029. Forcing Sotomayor out is just another Progressive Liberals wet dream and isn’t going to happen.
