Jack Smith is appealing the decision that his appointment was illegal

Good day all. There are lots of things going on, especially with the attempted assassination of President Trump and the successful coup against Dementia Joe Biden. One of the things was the dismissal of the Florida case by Judge Cannon, declaring that Jack Smith’s appointment was unconstitutional.


This little detail came out late last year when an Amicus Brief was submitted to the Supreme Court by former Attorney general Ed Meese. In it he and two other legal and constitutional scholars wrote that Smith’s appointment was illegal since he wasn’t approved by the Senate.

The recent decision regarding presidential immunity by the Supreme Court also had a concurring decision by Justice Thomas bringing this up. Finally, Judge Cannon tossed the case using this as her reason. Now the ever corrupt Jack Smith is appealing this. Here are the details from Newsmax:

Special counsel Jack Smith on Wednesday appealed U.S. District Judge Aileen Cannon’s dismissal of the case involving former President Donald Trump and his alleged mishandling of classified documents, NPR reported.

The judge’s 93-page order held that Smith’s selection as special counsel violated the Constitution because he was named to the position directly by Attorney General Merrick Garland instead of being appointed by the president and confirmed by the Senate.

Judge Cannon quoted the relevant sections of the Constitution when she dismissed the case. Since Jack Smith, Merrick Garland, Joe Biden and the entire Democrat Party have no use for the Constitution, they have decided that they should appeal to one of their friendly Obama or Biden judges.

Prosecutors vigorously challenged that argument when it was raised by Trump’s lawyers and filed a formal notice of appeal Wednesday to initiate the process.

I can’t say how the appellate court will rule, but you can bet you bottom dollar that this will end up in the Supreme Court. This brings up another problem for Smith and Garland.

In a concurring opinion in the U.S. Supreme Court’s recent ruling that Trump has immunity from prosecution for official acts, Justice Clarence Thomas questioned the legality of Smith’s appointment.

This is going to the 11th Circuit. I just checked it and it has a mix of Obama, Trump, and Biden judges with a few Bush Deep State judges. If they’re actually honest and read the Constitution, Smith is out. However, it doesn’t look like they do and the Trump appointees are outnumbered. (They generally do read the constitution)

The U.S. Court of Appeals for the 11th Circuit has overturned other Cannon rulings in the Trump classified documents case, siding with the Justice Department, according to Axios. And Trump-appointed Cannon had postponed the trial indefinitely prior to her dismissal of the case.

I can’t say for sure, but I think they also overturned the ruling on Presidential immunity. Then it went to the Supreme Court and they said “Nice try, but no. Presidents do have some immunity. This case, regarding the legality of Smith’s appointment is, for anyone who actually reads the Constitution, pretty cut and dry. Garland illegally appointed and funded Jack Smith. Therefore his cases against President Trump and all the others are invalid.

By the time this is ruled on by the 11th Circuit, the election will probably be over and if things go as anticipated, we will be seeing the return of the Greatest President of the 21st Century, Donald Trump, to the Oval Office. By January 20th 2025, at 1PM EST, Jack Smith and his entire team of troglodytes will be out on the street, and probably looking for their own legal representation. I also expect the new Congress to put forward legislation to flat out stop the next Merrick Garland and Jack Smith in their tracks.
